Terms of Service

These Terms of Service govern your access to and use of Dermiva, including the mobile app, website, AI skincare analysis, subscriptions, and related services.
Acceptance
By creating an account, using Dermiva, starting a scan, subscribing, or accessing any Dermiva service, you agree to these terms and to our Privacy Policy. If you do not agree, do not use Dermiva.
Eligibility and accounts
- You must meet the minimum age required in your region to use Dermiva.
- You are responsible for keeping your account and device secure.
- You agree to provide accurate information and keep it reasonably up to date.
- You are responsible for activity that occurs through your account, except where caused by Dermiva's own failure to use reasonable care.
What Dermiva provides
Dermiva provides AI-assisted skincare guidance. Features may include a guided face scan, visible skin-signal estimates, skin reports, AM/PM routine suggestions, product suggestions, routine tracking, progress history, reminders, and an in-app AI skin assistant.
Dermiva is designed for personal skincare education and daily care support. Features may change as the app evolves, and some features may require an active subscription.
Not medical advice
Dermiva is not a medical device and does not provide medical advice, diagnosis, treatment, or cure. Skin scores, scan results, chat responses, product suggestions, and routine suggestions are cosmetic estimates generated from automated analysis and user-provided context.
Always consult a qualified dermatologist or healthcare professional for medical concerns, allergic reactions, infections, pain, severe acne, rapidly changing skin findings, persistent irritation, or anything urgent. Do not delay seeking professional care because of information provided by Dermiva.
AI limitations
- AI outputs can be incomplete, inaccurate, delayed, or unsuitable for your specific skin.
- Scan results depend on lighting, camera quality, framing, makeup, image clarity, and the information you provide.
- Product suggestions may rely on product data from third parties and may not reflect every ingredient, regional formulation, stock status, price, or warning.
- Patch test new products, read product labels, follow manufacturer instructions, and avoid ingredients you know you react to.
- You remain responsible for deciding whether to follow any routine, product, or assistant suggestion.
Consent, scans, and user content
You control when a scan happens. By starting a scan or uploading a selfie, you confirm that you have the right to provide that image and you authorize Dermiva and its service providers to process it to provide the app features described in these terms and the Privacy Policy.
You keep ownership of photos, chat messages, profile information, and other content you provide. You grant Dermiva a limited license to host, process, transmit, display, and use that content as needed to operate, secure, support, personalize, and improve Dermiva.
Do not upload images or content you do not have permission to use, and do not upload images of another person unless you have all required rights and consent.
Subscriptions and purchases
Dermiva may offer auto-renewing subscriptions, such as weekly, three-month, or yearly plans, and may offer promotional pricing or free trials when shown in the app or store checkout. The exact plan, trial duration, renewal period, price, currency, taxes, and included features are shown before purchase in the App Store or Google Play checkout.
- Subscriptions automatically renew unless canceled before the renewal date according to the App Store or Google Play rules that apply to your purchase.
- If a free trial or introductory offer is available, it converts to a paid subscription at the end of the offer period unless canceled before the offer ends.
- Purchases, billing, renewal notices, cancellations, refunds, and payment disputes are handled by Apple or Google under their terms and policies.
- You can manage or cancel subscriptions in your App Store or Google Play account settings.
- Deleting the Dermiva app or deleting your Dermiva account does not automatically cancel a subscription managed by Apple or Google.
- Use the Restore option in the app to reconnect an eligible purchase to your Dermiva account.
Acceptable use
- Use Dermiva only for lawful, personal skincare purposes.
- Do not reverse engineer, copy, scrape, resell, or exploit Dermiva or its data except as allowed by law.
- Do not interfere with the service, bypass subscription controls, overload the backend, or attempt unauthorized access.
- Do not submit harmful, illegal, misleading, infringing, abusive, or privacy-violating content.
- Do not use Dermiva to make medical decisions for another person or to provide professional medical, dermatology, or cosmetic treatment advice unless you are independently qualified and legally authorized to do so.
Third-party services and stores
Dermiva relies on third-party services, including app stores, authentication providers, cloud providers, analytics and diagnostics providers, purchase infrastructure, AI providers, and product data sources. Their services may be governed by their own terms and privacy policies. Dermiva is not responsible for third-party products, websites, stores, manufacturer claims, or product availability.
Intellectual property
Dermiva, including its software, design, text, graphics, trademarks, algorithms, workflows, and content, is owned by Dermiva or its licensors and is protected by intellectual property laws. These terms do not transfer ownership of Dermiva to you. You may use Dermiva only as permitted by these terms.
Feedback
If you send ideas, suggestions, or feedback, you allow Dermiva to use them without restriction or compensation, unless a separate written agreement says otherwise.
Privacy and deletion
Our Privacy Policy explains how Dermiva handles personal data. You can withdraw face-analysis consent or delete account data from Settings. If you cannot access the app, visit our account and data deletion page.
Analytics and cookies
Our website uses Google Analytics cookies to measure traffic and improve the site. How this works, and how you can opt out, is described in our Privacy Policy.
Suspension and termination
You may stop using Dermiva at any time. We may suspend or terminate access if we reasonably believe you violated these terms, created risk for Dermiva or other users, misused the service, or if we must do so for legal, security, or operational reasons. Termination does not automatically cancel subscriptions managed by Apple or Google.
Service changes and availability
We work to keep Dermiva available, but the service may be interrupted, delayed, changed, or discontinued. We may update, remove, limit, or change features, providers, models, subscriptions, and content. We are not responsible for interruptions caused by networks, app stores, devices, third-party providers, maintenance, security events, or events outside our reasonable control.
Disclaimers
Dermiva is provided "as is" and "as available." To the fullest extent permitted by law, Dermiva disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation. Some jurisdictions do not allow certain disclaimers, so some of these limitations may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Dermiva and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, personal decisions made from cosmetic guidance, product reactions, or third-party products. Nothing in these terms limits liability where the law does not allow it to be limited.
Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold Dermiva harmless from claims, damages, losses, liabilities, and expenses arising from your misuse of Dermiva, your content, your violation of these terms, or your violation of another person's rights.
Changes to these terms
We may update these terms as Dermiva evolves. If changes are material, we will update the last updated date and provide additional notice where required. Continued use after updated terms take effect means you accept the updated terms.
